Open Letter of Hizb ut Tahrir Wilayah Pakistan to the Security Services and the Judiciary

Praise be to Allah, and peace and blessings be upon the best of creation, our Master Muhammad, his family and all those who follow him until the Day of Judgment.

Peace be upon those who follow guidance,

It has been our practice, when sending open letters, that they be directed to the regime and its head, in accordance to what was mentioned in the Book of Allah, The Almighty,

وَإِذْ قَالَتْ أُمَّةٌ مِنْهُمْ لِمَ تَعِظُونَ قَوْمًا اللَّهُ مُهْلِكُهُمْ أَوْ مُعَذِّبُهُمْ عَذَابًا شَدِيدًا قَالُوا مَعْذِرَةً إِلَى رَبِّكُمْ وَلَعَلَّهُمْ يَتَّقُونَ

“When a group of them said, “Why do you exhort a people whom Allah is going to destroy or chastise with a severe punishment?” They said, “To absolve ourselves before your Lord (by fulfilling our duty of forbidding evil), and perhaps they may fear Allah.” (Surah al-A’raaf 7:164)

We know well that the current political and military leadership are agents of the West to the bone. They have openly declared hostility to Islam and the Muslim Ummah and their hands drip with pure blood of Muslims. Thus, they are among those on whom applies the saying of Allah سبحانه وتعالى that He will destroy them in this life and the Hereafter. However, regardless of how far a disobedient transgressor goes in committing evil acts he remains a human who may still come to his senses. Therefore, we advise them with strong words, so that perhaps they may heed the advice and return to the right path and to the bosom of their Ummah, rather than remaining in the embrace of the enemies of Allah سبحانه وتعالى, His Messenger ﷺ and the Believers.

As for you, O Muslims in the Security Services, we trust there is good in many of you. Some of you think that they implement decisions that are in the interests of Pakistan and its people, not realizing that these decisions are made by a political and military leadership that has sold the country and its people to the Kuffar colonialists. It has thereby condemned the people to humiliation and poverty, causing corruption in the land and among the people, and destroying everything. So, do not listen or obey the likes of these who conspire against your Ummah. Abdullah ibn Masood (ra) narrated that the Prophet ﷺ said,

«كَيْفَ بِكَ يَا عَبْدَ اللَّهِ إِذَا كَانَ عَلَيْكُمْ أُمَرَاءُ يُضَيِّعُونَ السُّنَّةَ وَيُؤَخِّرُونَ الصَّلَاةَ عَنْ مِيقَاتِهَا قَالَ كَيْفَ تَأْمُرُنِي يَا رَسُولَ اللَّهِ قَالَ تَسْأَلُنِي ابْنَ أُمِّ عَبْدٍ كَيْفَ تَفْعَلُ لَا طَاعَةَ لِمَخْلُوقٍ فِي مَعْصِيَةِ اللَّهِ عَزَّ وَجَلَّ».

“How will you be when there will be over you rulers who will neglect the Sunnah and delay the prayer from its proper time.” Ibn Masood (ra) asked, “O Messenger of Allah, what do you order me, O Messenger of Allah?” He ﷺ said, “O Abdullah, there is no obedience to the one who disobeys Allah.” [Ahmad]

You must know without doubt that the regime, headed by the political and military leadership, only implement that which is dictated to them by their master America. They have used you and continue to use you at home and abroad, in countries nearby and far away, to secure American interests in the region. In particular, America’s interest in preventing the Ummah from returning to its former glory through the implementation of Islam as a state that reunifies the Ummah under a Rightly Guided Khaleefah, like the Khulafa Rashideen who succeeded the Messenger of Allah ﷺ in the implementation of Islam. The regime is lying to you, and you know it is lying, when it says to you that what you are doing is for the benefit of the land and its people and that America’s war on Islam, “terrorism,” is your war. Regrettably, you obey it and convince yourselves of its lies, thus rendering true about you the saying of Allah سبحانه وتعالى,

قُلْ هَلْ نُنَبِّئُكُمْ بِالْأَخْسَرِينَ أَعْمَالًا الَّذِينَ ضَلَّ سَعْيُهُمْ فِي الْحَيَاةِ الدُّنْيَا وَهُمْ يَحْسَبُونَ أَنَّهُمْ يُحْسِنُونَ صُنْعًا

“Say: “Shall We tell you the greatest losers in respect of (their) deeds? (They are) those whose efforts have been wasted in this life while they thought that they were acquiring good by their deeds.” (Surah Al-Kahf 103-104)

How do you do this while you are from the believing servants of Allah سبحانه وتعالى? How?!

You also know that the latest chapter in the betrayal of your leaders is their adoption of the “National Action Plan,” which is an American plan to suppress Islam and Muslims and those who support them. The purpose of this plan – as is clear from its implementation – is pursuing and persecuting all those loyal to their Deen in Pakistan, particularly those who are carrying the call for the Khilafah on the way of the Prophethood, the Shebaab of Hizb ut-Tahrir, and the Mujahideen who are fighting the US occupation in Afghanistan. The prisons are filling up with such people and you are the ones who pursue them, kidnap and arrest them, and violate the sanctity of their homes and work places. It was narrated from Anas that RasulAllah ﷺ said,

«من روع مؤمنا لم تؤمن روعته يوم القيامة»

“Whosoever terrifies a believer will not be secure from being terrified on the Day of Resurrection.” (Kanz al-Ummal)

By such actions you become like the Alawwi “Shabiha” thugs of the Syrian tyrant, Bashar, in criminality and like the soldiers of the oppressive king who burnt the believers alive simply because they said our Lord is Allah

وَمَا نَقَمُوا مِنْهُمْ إِلَّا أَنْ يُؤْمِنُوا بِاللَّهِ الْعَزِيزِ الْحَمِيدِ

“And they resented them only because they believed in Allah, the Almighty, Worthy of all praise.” (Surah Al-Barooj 85:8)

As for you, O Judges in the courts of the regime, you know that the existing system in the country is a system of Kufr. Neither is its constitution the Quran, nor are its laws derived from the Quran and Sunnah of the Prophet (saw). Rather, it is a system based on the constitution framed by the British colonialists during their Raj, subsequently modified every time the interests of the West in Pakistan required a modification in it. The foremost of their interests is preventing the adoption of a constitution derived from the Quran and the Sunnah, as a constitution for the Khilafah on the way of the Prophethood. Yet you judge in cases that come to you by this man-made constitution! The regime legislates laws in favour of its master and you judge by them, not heeding whether you are judging by Islam or by Kufr, as if you have forgotten the words of Rasulallah ﷺ where he warns you,

«الْقُضَاةُ ثَلَاثَةٌ: وَاحِدٌ فِي الْجَنَّةِ، وَاثْنَانِ فِي النَّارِ، فَأَمَّا الَّذِي فِي الْجَنَّةِ فَرَجُلٌ عَرَفَ الْحَقَّ فَقَضَى بِهِ، وَرَجُلٌ عَرَفَ الْحَقَّ فَجَارَ فِي الْحُكْمِ، فَهُوَ فِي النَّارِ، وَرَجُلٌ قَضَى لِلنَّاسِ عَلَى جَهْلٍ فَهُوَ فِي النَّارِ»

“Judges are of three types, one of whom will go to Jannah and two to Hell. The one who will go to Paradise is a man who knows what is right and gives judgment accordingly; but a man who knows what is right and acts tyrannically in his judgment will go to Hell; and a man who gives judgment for people when he is ignorant will go to Hell.” [Abu Dawud]

O Muslims in the Security Services and Judiciary! We sincerely advise you that you stop the persecution of sincere Muslims, from those who are advocates of the Khilafah and others. How can you accept to follow the traitorous political and military leaderships who have decided to stand against the land, the people and their Lord? If you obey them, you will be equal with them in their crime, and your punishment in the hereafter will be no less severe than theirs, for Allah سبحانه وتعالى said,

وَقَالُوا رَبَّنَا إِنَّا أَطَعْنَا سَادَتَنَا وَكُبَرَاءَنَا فَأَضَلُّونَا السَّبِيلَا – رَبَّنَا آتِهِمْ ضِعْفَيْنِ مِنَ الْعَذَابِ وَالْعَنْهُمْ لَعْنًا كَبِيرًا

“And they will say: “Our Lord! Verily, we obeyed our chiefs and our great ones, and they misled us from the way. Our Lord! Give them double torment and curse them with a mighty curse!” (Surah Al-Ahzaab 33:67-68)

This is in the Hereafter. As for this world, now, in our time, the Ummah has become firm in its resolve to topple the tyrants, one after another. It will be able at the end of this “Spring”, by Allah’s leave, to establish the Khilafah Rashidah on the way of Prophethood, whose glad tidings were given by RasulAllah ﷺ. When this occurs, the excuse of a policeman, a judge or a regime thug that he was only obeying his leaders was helpless before them will not benefit them at all. Know that those who persist in harming the servants of Allah سبحانه وتعالى who work for the revival of this Ummah will be judged by the courts of the forthcoming Khilafah Rashida. They will be given the Shar’ii punishment that they deserve. Indeed, the punishment for the one who fights Allah and His Messenger and causes corruption is severe. Allah سبحانه وتعالى said,

إِنَّمَا جَزَاءُ الَّذِينَ يُحَارِبُونَ اللَّهَ وَرَسُولَهُ وَيَسْعَوْنَ فِي الْأَرْضِ فَسَادًا أَنْ يُقَتَّلُوا أَوْ يُصَلَّبُوا أَوْ تُقَطَّعَ أَيْدِيهِمْ وَأَرْجُلُهُمْ مِنْ خِلَافٍ أَوْ يُنْفَوْا مِنَ الْأَرْضِ ذَلِكَ لَهُمْ خِزْيٌ فِي الدُّنْيَا وَلَهُمْ فِي الْآخِرَةِ عَذَابٌ عَظِيمٌ

“Indeed the penalty for those who wage war against Allah and His Messenger and strive upon earth to cause corruption, is nothing else but that they be killed or that there hands and feet be cut off from opposite sides or that they be exiled from the land. That is for them a disgrace in this world and for them in the Hereafter is a great punishment.” (Surah Al-Maida 5:33)

Thus, here we advise you before it is too late. We say to you: support your Ummah and do not harm the righteous servants of Allah. Nay, more than this, we ask you to work with us to remove this regime and replace it with the Khilafah Rashidah on the way of Prophethood. Know that its establishment is now nearer than ever before, and then the Khilafah will not forgive those that harmed the Call to the Truth and its people. The one who warns has acted justly, and the one warned is left with no excuse.
