Judiciary Must Stand with the Advocates of the Khilafah not the Tyrants

The Raheel-Nawaz regime is relentlessly persecuting the Shebaab of Hizbut Tahrir, the sincere advocates of the Khilafah, whilst the judiciary is woefully neglecting its duty to uphold the truth in a state which was established in the name of Islam. On 5th December 2014, the regime raided a dars of Hizbut Tahrir in Lahore and imprisoned Muslims just because they were calling for Islam and rejecting the American Raj in the country. They remain languishing in prison, whilst the judiciary under pressure from the regime, continuously rejects their bail, or refers to other courts, or stall their hearings, for one reason or another. In addition numerous Shebaab of Hizbut Tahrir have cases against them with the judiciaries in Peshawar, Islamabad, Karachi and Lahore. They are regularly harassed by the thugs of the regime, which does not care for the honour of their women, the well-being of their children or the sanctity of their homes. And we must add that the official spokesman of Hizbut Tahrir in the Wilayah of Pakistan, Naveed Butt, remains in the dungeons of the tyrants since his abduction on 11 May 2012.

All these crimes are occurring whilst the regime gives open hand to American private military and intelligence, as well as the Indian spies, who fund, plan and supervise brutal attacks against the armed forces and civilians, including the attack upon the school children of the Army Public School in Peshawar on 16th December, which was only ten days after the raid on the Hizbut Tahrir Dars in Lahore. The regime gives open hand to the enemy, even though it is the duty of the state to protect the citizens from the enemy. A duty that demands the incapacitating of the American and Indian enemy to launch attacks on our soil, which in the very least must include closing of enemy embassies and consulates, rounding up of their spies and expelling any of their staff. Yet the traitors in the military and political leadership are left free in their open treachery, without a single challenge from the judiciary.

We remind the judiciary that Rasullah (saw) said in the authentic hadith, «الْقُضَاةُ ثَلَاثَةٌ: وَاحِدٌ فِي الْجَنَّةِ، وَاثْنَانِ فِي النَّارِ، فَأَمَّا الَّذِي فِي الْجَنَّةِ فَرَجُلٌ عَرَفَ الْحَقَّ فَقَضَى بِهِ، وَرَجُلٌ عَرَفَ الْحَقَّ فَجَارَ فِي الْحُكْمِ، فَهُوَ فِي النَّارِ، وَرَجُلٌ قَضَى لِلنَّاسِ عَلَى جَهْلٍ فَهُوَ فِي النَّارِ» “The judges are of three types: one is in heaven, the other is in fire. As for the one who is Jannah, he is the man who knows the truth and judges by it, whereas the one who knows the truth and aggrieves it in judgment, he is in fire. And the man who judges for the people on ignorance is also in fire.” [Abu Daud]. There is no excuse before Allah (swt) to know the truth and deviate from it through the pressure of the regime. They must judge by Islam, which made it mandatory to establish the Khilafah and forbade the persecution of anyone who calls to Islam.

We also remind the judiciary that RasulAllah (saw) warned the Muslims by saying ...«إِنَّمَا أَهْلَكَ الَّذِينَ قَبْلَكُمْ أَنَّهُمْ كَانُوا إِذَا سَرَقَ فِيهِمْ الشَّرِيفُ تَرَكُوهُ وَإِذَا سَرَقَ فِيهِمْ الضَّعِيفُ أَقَامُوا عَلَيْهِ الْحَدَّ وَايْمُ اللَّهِ لَوْ أَنَّ فَاطِمَةَ بِنْتَ مُحَمَّدٍ سَرَقَتْ لَقَطَعْتُ يَدَهَا» “The people before you were ruined because when a noble person amongst them committed theft, they would leave him, but if a weak person amongst them committed theft, they would execute the legal punishment on him. By Allah, were Fatimah, the daughter of Muhammad, to commit the theft, I would have cut off her hand.” [Bukhari]. And RasulAllah (saw) as the leader of the Muslims encouraged them to account the ruler by saying that, «فمَنْ كنتُ جلدتُ لهُ ظهراً فهذا ظهري فليَسْتَقِدْ منه، ومَنْ كنتُ شتمتُ لهُ عِرضاً فهذا عِرضي فليَسْتَقِدْ منه، ومن كنتُ أخذتُ لهُ مالاً، فهذا مالي فلْيَسْتَقِدْ منه» “Whoever I had whipped his back here is my back, let him retaliate! Whoever I had cursed his honor, here is my honor let him curse it! Whoever I had taken some money from him here is my money, let him take from it.”

The judiciary prevents the destruction of society by seizing the strong and supporting the weak. Yet, today, the brutal tyrants are supported whilst those who challenge by words of Truth their tyranny are seized. Are we to live again in a time like the British Raj? Is this woeful situation not a betrayal of the 190 years of struggle against the colonialists? So, will the judiciary not stand upright today before the rising American Raj and earn the good pleasure of Allah (swt) and the dua of the believers?
