Democracy is the Root Cause of Corruption, by Providing Legal Cover for Ruler’s Corruption

On Tuesday, 5th April 2016, the Prime Minister of Pakistan, Nawaz Sharif, addressed the nation to calm heightened anger over the Panama Papers’ leak. He tried to prove that his family is not involved in any financial corruption. The Panama Papers exposed the fact that because of Democracy, rulers and powerful people throughout the world, whether they are from the West or East, whether they belong to the developed or underdeveloped world, transfer their wealth with ease to places where their wealth will not be taxed or scrutinized.

In Democracy, people who are elected in the name of the people use their legislative authority to fulfil the interests of their masters, cronies and themselves. Democracy gives the right of legislation to the representatives of the people, so these representatives use this authority to declare a thing or an act Halaal (allowed) or Haraam (prohibited). Today a discussion is taking place throughout the world as to the need for legislation to compel the rulers to pay tax on their wealth, so that the common man can be relieved from tax burdens. However, one fundamental question that has been overlooked which is that how on earth will people who have been given the right to legislate, make laws against their own interests? Therefore whenever this sort of scandal surfaces, the ruling elite make more “stringent” laws or announce judicial commissions to calm public anger, but always leave loop-holes so that their interests remains unharmed in the long term. Moreover, Democracy allows the rulers to usurp the wealth of both the public and the state, through privatization. And Democracy makes this all possible and is clearly rule for the rich by the rich to get even richer.

The Khilafah is the only ruling system which does not discriminate between the ruler and the ruled or the elected and those who cast their vote. Neither the Khaleefah nor the Waalis (governor) nor the members of the Majlis ul-Ummah have the power of legislation because in Islam the people are not sovereign and sovereignty is only for Allah (swt). Therefore, politicians and rulers cannot make laws which serve their interests, rather they all must abide by the Quran and Sunnah, Revelation from Allah (swt) with the members of the Majlis ul-Ummah accounting the rulers for their implementation of Islam. Thus, whether it was the era of the Khilafah Rashidah or the Khilafah after that, no Khaleefah was ever able to issue a law preventing the taxation that is mandated by Shariah upon the wealth of the rulers. Indeed, in the time of the Khilafah Rashida, the rulers’ wealth was always under scrutiny, such that if a Waali had more wealth at the end of his term, than the beginning, the surplus was placed in the Bayt ul-Maal (State Treasury).

O Muslims of Pakistan!

Making existing Democratic laws more stringent or Democratic judicial commissions are not the solution for the corruption of Democratic rulers, they are only lip-service to quell your anger. The only solution to corruption is the abolition of Democracy and the restoration of the Khilafah (Caliphate) on the Method of the Prophethood, where ruling is not by the whims and desires of rulers, but by the Quran and Sunnah. Thus Islam will close the door of corruption forever by abolishing sovereignty for man, which is used by rulers to make laws to protect their interests. Only after the establishment of Khilafah will discrimination between ruler and ruled end. Allah (swt) said,

وَأَنِ احْكُمْ بَيْنَهُمْ بِمَا أَنْزَلَ اللَّهُ وَلَا تَتَّبِعْ أَهْوَاءَهُمْ وَاحْذَرْهُمْ أَنْ يَفْتِنُوكَ عَنْ بَعْضِ مَا أَنْزَلَ اللَّهُ إِلَيْكَ

“And judge between them by all that Allah has revealed, and do not follow their desires, and beware (O Muhammad) that they might seduce you from some of what Allah has sent down to you.” [Al-Maida:49]

O Officers of Pakistan’s Armed Forces!

Today, as a response to the Panama Papers, it is clear that the public opinion in Pakistan is against the current rulers and Democracy to the extent that the people are all referring to the era of Islam and Khilafah Rashidah in their discussions. So, what else are you waiting for? What excuse do you have before Allah (swt) to having not undertaken the necessary step to abolish Democracy and establish Islam? It is upon you to bring the change that the Muslims want and need, by granting Nussrah to Hizb ut Tahrir for the immediate re-establishment of the Khilafah (Caliphate) on the Method of the Prophethood, abolishing oppressive rule once and for all.

RasulAllah (saaw) said,

«ثُمَّ تَكُونُ مُلْكًا جَبْرِيَّةً فَتَكُونُ مَا شَاءَ اللَّهُ أَنْ تَكُونَ ثُمَّ يَرْفَعُهَا إِذَا شَاءَ أَنْ يَرْفَعَهَا ثُمَّ تَكُونُ خِلَافَةً عَلَى مِنْهَاجِ النُّبُوَّةِ ثُمَّ سَكَتَ»

“Then there will be an oppressive rule, and it will remain as long as Allah wills. Then Allah will end it when He wills. Then there will be a Khilafah according to the way of Prophethood.” Then he (saaw) fell silent.” (Ahmad)
