Press Release
Punishments in Form and Substance are Shariah Rules and
Cannot be Relinquished to Please Different Deities
(Translated)
The parliament in Sudan approved on Thursday, 22/09/2016, the amendments to the Criminal Code, including the amendment of the penalty of “the married adulterer” from stoning to hanging. What is next is to wait for the amendments to be forwarded to parliament for approval once and for all. The amendments submitted by the Justice Minister Awad Al-Hassan in the parliament session, on Thursday, included tightening the punishment of the “married adulterer” to “hanging” instead of “stoning”. (Sudan Tribune Website, 22 September 2016.)
In line with the human rights pacts signed by Sudan and moving away from and compromising even the Islamic slogans, and rejection of various Hudood punishments in Sudan’s criminal law, it has become incumbent to change this article and other Shariah rules relating to the Hudood punishments. This was actually preceded by signs and several hints by the Ministry of Justice; which indicated the presence of articles in the Sudanese laws contrary to Islamic law and international conventions, and need to be reviewed. The Justice Minister Awad Hassan An-Noor said to inform the media that the subjects of apostasy and stoning in criminal law contradict Islamic law and international conventions, adding that he initiated a discussion with the Islamic Fiqh Academy, on the matter of the balance between the Shariah law and the present era. He continued asking, “Is it possible to apply the death by stoning in this day and age?” (Attayar, 11/05/2016)
Changing the penalty for adultery is a mockery of Islamic rulings, and distortion and altering of the laws of Allah (swt), and ending achieving the calls of the Kaffir West, and it applies perfectly with what Daniel Bekele, Executive Director of the Africa division at Human Rights Watch, “No one should be stoned to death, Sudan should immediately reform discriminatory laws and abolish both the death penalty and all corporal punishments that violate the international treaty obligations it has promised to respect.” (31 May 2012).
O you who believe, is it not time for you to support Allah’s law, by standing against the advocates of so-called human rights, from the rulers and their tools, who are seeking to secularize the country openly, those Westernized, who accuse the Islamic punishment system and Hudood rules as barbaric, and violating human rights, and they change its Shariah rules in response to the plans of the Kaffir West and legislation, and mocking the Law of the Lord of the people, and ignoring its wisdom to achieve deterrence and rebuke and discipline for those who cause mischief, according to the type of offense committed? In His Wisdom, Knowledge and Mercy, Allah (swt) assessed penalties of some of these crimes, including adultery, in form and weight, because of the fixed corruption it brings, that does not change, with time and place, by removing the sin and the removal of any modifications by the people. And we as Muslims, have accepted this, in worship to Him (swt), not the lewd laws of Kufr, praise be to Allah, who proscribed the punishments to deter the corrupt, and bring goodness for all mankind, and to rebuke the aggressors, He (swt) says:
وَلا تَأْخُذْكُم بِهِمَا رَأْفَةٌ فِي دِينِ اللَّهِ إِن كُنتُمْ تُؤْمِنُونَ بِاللَّهِ وَالْيَوْمِ الآخِرِ وَلْيَشْهَدْ عَذَابَهُمَا طَائِفَةٌ مِّنَ الْمُؤْمِنِينَ
“…and do not be taken by pity for them in the religion of Allah, if you should believe in Allah and the Last Day. And let a group of the believers witness their punishment” [An-Noor: 2]
Only the righteous Khilafah State (Caliphate) on the method of Prophethood that will implement the Law of Allah, without distortion or modification to please the different deities, reality proved that the quasi-states in which we live, do not dare except to disrupt the Law of Allah, and keep pace with international laws! Oh Allah, hasten its return, so that it may make the Westernized politicians forget the whispers of the devils. Allah (swt) said:
“So follow not [personal] inclination, lest you not be just. And if you distort [your testimony] or refuse [to give it], then indeed Allah is ever, with what you do, acquainted” [An-Nisa’: 135]
