Setelah Enggan Tabayyun dan Berhujah Secara Intelektual, Kini Dakwah Hizbut Tahrir Cuba Disekat pula dengan Penangkapan dan Intimidasi!
Jurucakap Hizbut Tahrir Malaysia (HTM), Ustaz Abdul Hakim Othman telah ditangkap oleh sepasukan pegawai penguatkuasa agama daripada Jabatan Agama Islam Selangor (JAIS) pada Selasa 30/03/2021, sejurus keluar dari Mahkamah Rendah Syariah Hulu Langat. Tangkapan tersebut dilakukan setelah waran tangkap dikeluarkan oleh Mahkamah Rendah Syariah Johor Bahru bagi memaksa beliau hadir ke pejabat Jabatan Agama Islam Negeri Johor (JAINJ) untuk memberi keterangan di bawah Seksyen 58 Enakmen Kesalahan Jenayah Syariah (Johor) 1997, berhubung kesalahan di bawah Seksyen 9 dan 12 Enakmen yang sama. Tangkapan dilakukan kerana tindakan beliau yang menyerahkan Memorandum Bantahan kepada Jabatan Mufti Johor pada 27/09/2020, terkait dengan fatwa Johor ke atas Hizbut Tahrir. Jurucakap HTM itu terus dibawa ke Johor menaiki van JAIS sejurus selepas tangkapan. Beliau telah menjalani tahanan lokap, sebelum disoalsiasat selama setengah hari dan dibebaskan keesokannya dengan jaminan dengan dua orang penjamin.
Setelah Jawatankuasa Fatwa Johor mengeluarkan fatwa yang sarat dengan fitnah, pendustaan, pemesongan fakta dan kekeliruan ke atas Hizbut Tahrir, kini pihak berkuasa agama negeri itu menggunakan kuasa yang ada pada mereka untuk menangkap Jurucakap HTM, hanya kerana tindakan beliau yang cuba menjelaskan bahawa fatwa tersebut dipenuhi fitnah dan pendustaan! Pihak berkuasa agama Johor bukan sahaja enggan melakukan tabayyun sebelum mengeluarkan fatwa, menolak untuk berhujah secara intelektual dan menutup pintu kepada sebarang perjumpaan dan muzakarah, malah kini mereka melakukan tangkapan pula ke atas Jurucakap HTM! Bagaimana mungkin menjawab fitnah dijadikan satu kesalahan jenayah oleh JAINJ!? Sungguh memalukan apa yang mereka lakukan – mereka menabur pelbagai fitnah, lalu kemudian menangkap pihak yang mereka fitnahkan!
Kami dengan ini sekali lagi ingin menyatakan dengan jelas dan tegas bahawa fatwa yang dikeluarkan oleh Jawatankuasa Fatwa Johor adalah sebuah “fatwa politik” yang bertujuan menyekat dakwah Hizbut Tahrir, sebuah parti politik Islam yang gigih berusaha siang dan malam untuk mengembalikan semula kehidupan Islam secara kaffah dengan jalan menegakkan kembali Daulah Khilafah ar-Rasyidah ala minhaj nubuwwah. Hizbut Tahrir berjuang untuk menerapkan Kitabullah dan Sunnah Rasul-Nya dalam kehidupan individu, bermasyarakat dan bernegara, yang mana usaha ini menyebabkan Barat dan ejen-ejen mereka tidak lena tidur. Hizbut Tahrir ingin mempersatukan kembali umat Islam di bawah satu negara, satu kepimpinan dan satu bendera, yang mana perjuangan ini amat ditakuti oleh kuffar Barat, sehingga kuffar Barat mengerahkan segenap usaha dan kekuatan yang mereka ada, termasuk menggunakan ejen-ejen mereka di negara kaum Muslimin, untuk menyekat dakwah Hizbut Tahrir, dengan pelbagai cara.
Wahai pihak berkuasa agama Johor! Ketahuilah bahawa segala fitnah, intimidasi dan penangkapan yang anda lakukan ke atas mana-mana anggota Hizbut Tahrir sama sekali tidak akan menghentikan dakwah Hizbut Tahrir. Ia juga tidak akan melambatkan, walaupun satu saat, berdirinya kembali Daulah Khilafah ar-Rasyidah ala minhaj nubuwwah yang Hizbut Tahrir perjuangkan. Ingatlah dan ambil pengajaranlah daripada pesan Rasulullah (saw) bahawa fitnah itu akan pasti kembali kepada tuannya!
Wahai pihak berkuasa agama Johor! Sesungguhnya kami sedikit pun tidak risau dengan penangkapan mahupun pendakwaan yang anda lakukan ke atas mana-mana anggota Hizbut Tahrir, tetapi apa yang kami risaukan ialah anda! Kami ulangi, apa yang kami risaukan ialah anda! Apa agaknya jawapan anda di Padang Mahsyar kelak kepada Hakim Yang Maha Adil apabila anda ditanya darihal fitnah, pembohongan, penangkapan dan kezaliman yang anda lakukan ke atas Hizbut Tahrir dan para anggotanya!? Ya, kami cukup risau apabila Allah (swt) mencabut nyawa anda tatkala anda belum sempat bertaubat kepada-Nya, kerana kami meyakini firman-Nya:
﴿إِنَّ الَّذِينَ فَتَنُوا الْمُؤْمِنِينَ وَالْمُؤْمِنَاتِ ثُمَّ لَمْ يَتُوبُوا فَلَهُمْ عَذَابُ جَهَنَّمَ وَلَهُمْ عَذَابُ الْحَرِيقِ﴾
“Sesungguhnya orang-orang yang mendatangkan cubaan kepada orang-orang yang beriman lelaki dan perempuan, kemudian mereka tidak bertaubat, maka bagi mereka azab (neraka) Jahanam dan bagi mereka azab (neraka) yang membakar” [Al-Buruj (85):10].

After Refusing to Verify (Tabayyun) and Discuss Intellectually, They Now Try to Halt the Da’wah of Hizb ut Tahrir by Detention and Intimidation!
The spokesperson of Hizb ut Tahrir / Malaysia (HTM) was arrested by a group of enforcement officers from the Selangor Islamic Religious Department (JAIS) on Tuesday 30/03/2021, right after leaving the Hulu Langat Shariah Lower Court. The arrest was made after Johor Bahru Shariah Lower Court had issued a warrant of arrest, forcing his attendance to the office of Johor Islamic Religious Department (JAINJ), to give a statement under Section 58 of Shariah Criminal Offences Enactment (Johor) 1997, for an offence under Section 9 and 12 of the same Enactment. This arrest is related to his submission of the Memorandum of Protest to the Johor Mufti Department on 27/09/2020 with regards to the Johor fatwa against Hizb ut Tahrir. The HTM’s spokesperson had been brought to Johor by JAIS’s van right after the arrest. He was locked up, before undergoing a half day interrogation, and released the next day on bond with two sureties.
After the Johor Fatwa Committee issued the fatwa which is full of defamation, fabrication, distortion of facts, and confusion against Hizb ut Tahrir, now, the state’s religious authority resorted to using their power to apprehend the spokesperson of HTM, merely for his statement that the fatwa is full of slander and fabrication against the party! The said religious authority is not only refusing to carry out verification (Tabayyun) before issuance of the fatwa, refuting to engage in intellectual debate, and closing all doors for meeting and discussion, now, they have resorted to arresting a member of Hizb ut Tahrir! How could answering the slander be considered a crime by JAINJ?! What a shameful act!!! They spread all kind of defamation, and then detained those whom they defamed!
We hereby would like to reiterate clearly and firmly that the fatwa by the Johor Fatwa Committee is a “political fatwa” that serves to deter the Da’wah of Hizb ut Tahrir which is working tirelessly day and night towards the resumption of the comprehensive Islamic way of life by re-establishing the Righteous Caliphate upon the method of the Prophethood. Hizb ut Tahrir has been working to implement the Book of Allah (swt) and the Sunnah of His Messenger (saw) in the personal life, in the society and the State – works that has caused the West and their agents to have sleepless nights. Hizb ut Tahrir aims to reunite the Ummah under one State, one leadership and one flag and this strikes fear in the hearts of the Kuffar, which prompts them to mobilize their agents in the Muslim countries to suppress the Da’wah of Hizb ut Tahrir by any possible means.
O religious authority of Johor! All the slander, intimidation, and detention that are perpetrated upon the members of Hizb ut Tahrir will never succeed in halting the Da’wah of Hizb ut Tahrir. You will also fail to delay, even for a split second, the return of the Righteous Caliphate upon the method of the Prophethood which Hizb ut Tahrir is working towards. Take heed of the reminder of Rasulullah (saw) that the slander will definitely return to its owners!
O religious authority of Johor! We are not worried even the slightest bit of the detention and prosecution of any member of Hizb ut Tahrir – we are worried about you instead! We repeat, we are worried about you! What would your answers be in the field of Mahshar, in front of the Most Just Judge when you are held accountable for all the slander, fabrication, detention, and injustice which you have committed against Hizb ut Tahrir and its members!? Verily, we are worried that Allah (swt) will snap your soul before you manage to repent to Him (swt), as we firmly believe in His (swt) Words;
﴿إِنَّ الَّذِينَ فَتَنُوا الْمُؤْمِنِينَ وَالْمُؤْمِنَاتِ ثُمَّ لَمْ يَتُوبُوا فَلَهُمْ عَذَابُ جَهَنَّمَ وَلَهُمْ عَذَابُ الْحَرِيقِ﴾
“Verily, those who put into trial the believing men and believing women, and then do not turn in repentance, then they will have the torment of Hell, and they will have the punishment of the burning Fire” [Al-Buruj (85):10].
